What exactly is covered by building law?

Building law is divided into private and public building law and deals with rights and obligations relating to house construction.

Private construction law is aimed at the client and the contractor of construction projects in the form of private individuals and companies. This includes legal matters between the client, owner or neighbor on the one hand and the developer or parties involved in the planning and implementation such as engineers, architects and construction companies on the other.

Public building law deals with the realization of building projects and is aimed at private individuals who have to interact with the state for a building project. It therefore includes planning, land use and building regulations law and thus regulations on development planning, land use and hazard prevention.

What both types of construction law have in common is that construction law cases predominantly deal with remuneration issues, discussions about defects and liability claims in cases of real estate fraud. The numerous construction projects and the increasing internationalization (especially through crowdinvesting) are constantly adding new case constellations and questions to construction law.

Crowdinvesting in real estate

Crowdinvesting or swarm financing refers to the financing of a project by a crowd, a group of backers. Private capital is exclusively provided to real estate investors, who can then replace part of the equity in the loan. Unfortunately, crowdinvesting also involves considerable risks for investors.
